Things you may not know about Bruce Lehrmann’s Misguided Defamation Claim and What to Believe – Demeanour versus Documents

Abstract: This presentation will prompt thinking about the assessment of lay witness evidence against the backdrop of the broader factual context explored during Lehrmann’s misguided defamation trial. That broader context included Lehrmann’s earlier harassment before the rape, and the process to terminate his employment. There will also be discussion of issues around proving sexual harassment in court, including a case example in which the Court found the evidence of both key witnesses was unsatisfactory.
